Terms of Service

These Terms govern your use of the Odysser website, Ody for iPhone, and related services (the “Service”). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old and legally able to enter this agreement. If you use the Service for an organization, you confirm that you may bind it to these Terms.

• Provide accurate information and keep your sign-in credentials secure.
• You are responsible for activity under your account and should tell us promptly about unauthorized access.
• We may limit or suspend accounts used unlawfully, fraudulently, or in violation of these Terms.

Odysser provides video-editing tools, including AI-assisted transcription, editing, captions, generation, and export. AI output can be incomplete, inaccurate, or unsuitable. Review every result before publishing or relying on it.

You are responsible for your creative and publishing decisions. The Service is not professional, legal, medical, financial, or safety advice.

You keep ownership of content you upload or create. You give Odysser a limited license to host, process, reproduce, and modify that content only as needed to provide, secure, and improve the Service.

You confirm that you have the rights and permissions needed for your content, including music, footage, voices, likenesses, trademarks, and personal information. You are responsible for your content and how you use or publish the output.

Do not use the Service to:

• Break the law, infringe rights, invade privacy, or create deceptive or harmful content.
• Upload malware, disrupt the Service, bypass security or usage limits, or access another person’s account.
• Reverse engineer, scrape, resell, or misuse the Service except where applicable law expressly allows it.
• Present AI-generated content as authentic where doing so would deceive or harm others.

Prices, billing periods, trial terms, and included features are shown before purchase. Subscriptions renew automatically unless canceled at least 24 hours before the current period ends. Features and pricing may change with notice where required.

Apple processes Ody purchases. Manage or cancel them through your Apple Account and restore eligible purchases from Ody’s membership screen. Deleting Ody or your account does not cancel an Apple subscription. Apple handles refunds and billing disputes under its policies.

Website purchases are handled through the checkout and account tools shown during purchase. Taxes may apply. Except where required by law, fees already charged are non-refundable.

Odysser and its licensors own the Service, software, designs, brand, documentation, and technology, excluding your content. We give you a limited, personal, revocable, non-transferable right to use the Service as intended.

If you send feedback, you allow us to use it without restriction or payment, without transferring ownership of your content.

Some features depend on third-party services, app stores, or content. Their terms may also apply. We are not responsible for their independent availability or conduct, but this does not limit rights that cannot be waived by law. Apple’s Standard EULA also applies to Ody.

We may update, change, suspend, or discontinue features to maintain, secure, or improve the Service. We do not guarantee uninterrupted or error-free availability. Keep copies of important source media and exports.

You may stop using the Service at any time. We may suspend or terminate access for a material violation of these Terms, legal requirements, or risks to users or the Service. Account deletion does not automatically cancel a subscription.

To the extent permitted by law, the Service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, or uninterrupted operation.

To the extent permitted by law, Odysser will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, opportunities, or data. Odysser’s total liability for a claim will not exceed the greater of the amount you paid for the affected Service during the previous 12 months or US $100.

These limits do not apply where prohibited, including to rights or liability that applicable law does not allow us to exclude.

Applicable law governs these Terms, while mandatory consumer rights and access to local courts remain unaffected. If one provision is unenforceable, the remaining provisions continue. Failure to enforce a provision is not a waiver.

These Terms, the Privacy Policy, purchase disclosures, and applicable feature-specific terms form the agreement between you and Odysser.

We may update these Terms and will provide notice of material changes where required. Continued use after the effective date means you accept the updated Terms.
